1. INTRODUCTION
The terms and conditions apply to the content and services (the “Services”) to which access is provided through the website (the “Website”). Upon use of the Services, the user accepts to be bound by these terms and conditions. The Services are provided by CYTA and include access to CYTA’s Directories Website with the purpose of obtaining information and a link to the relevant form for submitting an application for a Directory listing.

2. REGISTRATION
2.1. Where users wish to obtain a listing in any of CYTA’s Directories, they should print out the relevant form to which there is a link on the Website and send it to CYTA. In such a case they will be required to provide some personal information such as their name, address or other details. Users are obliged to provide true, accurate, updated and complete information regarding themselves and they are bound to keep this information updated.

2.2. If CYTA (including its officers and employees) has reasonable grounds to believe that any information provided is false, inaccurate, out of date or incomplete, CYTA shall have the right not to refuse to include the listing in the relevant Directory without prior notice.

3. USER’S ACTIVITIES
3.1. Users shall not use the Services to:
a) transmit or dispose of in any way, any content which is illegal, harmful, harassing, threatening, embezzling, fraudulent, defamatory, libelous, deceitful, pornographic, indecent, which violates privacy or is otherwise improper.
b) discriminate, undermine or offend a person or a group of persons based on religion, sex, race, nationality, age or inability.
c) harm minors in any way.
d) send or dispose of in any way content which violates a patent, copyright, trademark, Service logo, trade secret or other proprietary rights of any person.
e) send and/or distribute any unsolicited material for which no consent has been given.
f) collect, use, store or track personal data and/or information.
g) offend the Constitution or any law or International Convention which are legally enforceable in Cyprus.

3.2. CYTA reserves the right to hinder or postpone a user’s access to the Services in case of any violation of the present Section 3 above.

4. CHARGEABLE SERVICES
Users agree that they have read and accepted the prices as they appear on forms published by CYTA from time to time.

5. INDEMNITIES
For the duration of this Agreement and after its termination, users shall indemnify and keep CYTA, its subsidiaries, shareholders, officers, management, employees and successors free from all claims, suits or grounds for suits, losses, liabilities, costs and expenses, including legal fees, which may be claimed by or caused to third parties and which arise from the violation of the present Terms and Conditions or the use of the Services.

6. TERMINATION - SUSPENSION OF SERVICE
CYTA reserves the right at any time and without explanation to:

a) upgrade, modify or temporarily suspend the Services, or prevent their use, or deny or prevent access to the Services

b) remove any content or material that is placed or stored with the Services for any reason, including but not restricted to the violation of the present terms and conditions. Users shall be informed of any changes to the present terms and conditions.

7. LIMITATION OF LIABILITY
7.1. CYTA shall not be liable for any direct, indirect, exemplary, casual, specific or punitive damage for loss of profit, reputation or other damage which is caused by:

a) the use or inability to use the Services.

b) any product, data, information or services obtained or to which access is gained via the Services.

c) unauthorized access or modification of data.

d) claims arising from use of the software.

e) denial of the rights of any person, of any kind which are exercised or attempted to be exercised via the Services.

f) interruption of the Services.

g) payments or wrong payments.

7.2 CYTA is not liable for any claims arising from the automatic, temporary storage of information and data for the exclusive purpose of facilitating the further transfer of such information to the recipient of a requested service, or the partial or total loss, or the wrong sending or non-sending, of such information.

7.3 Listings and advertisements in CYTA’s Directories are made according to the information provided by customers to CYTA, as in Section 2 above. CYTA is not liable for the accuracy or legitimacy of information provided by users or customers. CYTA bears no responsibility for the accuracy of listings, any inadequacies, listing errors, advertisements or printing errors. CYTA does not oversee the content that is stored or transferred via the Services and does not guarantee the reliability, integrity or quality of any content. CYTA is not responsible for any loss or damage arising from content that is stored or transferred or made accessible via the Services.

7.4 The purpose of the professional categories in the Directories is to facilitate searches and they are not necessarily absolutely correct professional descriptions. The listing of a business or an individual in a category does not necessarily mean that they provide the products or services suggested by the particular category, not that they are legally or professionally registered to provide such products or services. CYTA’s Directories are not agents for advertisers and they do not guarantee that advertisers are registered professionally, which is the responsibility and jurisdiction or the Associations, Chambers or Professional Bodies to which they belong.

7.5 CYTA is not liable for any advertisement, commercial transactions, products, services or other material appearing on the Website.

7.6 CYTA does not provide any guarantees, either stated or inferred, including though not restricted to inferred guarantees of commerciality and suitability for any purpose, which are hereby excluded. Specifically and without restrictions, CYTA does not guarantee that access to its Website will be uninterrupted, timely, secure or without flaws or that access will be available at any time or from any locality.

7.7 CYTA is not responsible for any defamation of any person or product or service regarding contested intellectual property rights or trade names or trademarks or patents or failure to obey a court order or denying the right to privacy of any person or the breach of any contract or wrongful act or other denial or violation or a right or any wrongful act that any one attempt to commit via the Services.

8. COPYRIGHT, TRADEMARKS
The Website, the Services and the software which is linked to the Services and all the material or content constitute intellectual property belonging to CYTA. Copying, reproducing, disposing of, commercially using or creating derivative works from the above is hereby forbidden without CYTA’s express and written approval.

9. APPLICABLE LAW
The present terms and conditions are subject to Cypriot Law and any dispute which arises shall be resolved before the Courts of Cyprus.
